NOTICE OF PENDENCY OF SETTLEMENT OF CLASS, COLLECTIVE, REPRESENTATIVE ACTION

PLEASE READ THIS WEBSITE CAREFULLY. YOUR LEGAL RIGHTS ARE AFFECTED WHETHER YOU ACT OR NOT.  

A proposed class, collective, and representative action settlement has been reached between the Parties in the above-entitled actions and preliminarily approved by the Court as described below. You have received a notice because Heartland Express, Inc. of Iowa’s and/or Interstate Distributor Co.’s (collectively “Defendants”) records indicate that you are an individual who falls within one or more of the settlement classes (a “Class Member”) and are entitled to participate in the Settlement.



Defendant’s records indicate that you are a member of the following Class(es):

California Class: Defendant’s California-resident long-haul drivers whose last known address is in California and who drove for Defendants in the state of California for at least some portion of one or more weeks from December 20, 2013 through March 13, 2023 excluding individuals who have released all of the California Class Released Claims during that period through a prior settlement, as explained more fully below.  More information about the California Class can be found in the California and Washington Class FAQ section of this website.

Waiting Time Penalties Subclass: means all members of the California Class whose employment with Defendants ended at any point on or after December 20, 2014.

Washington Class: Defendant’s long-haul drivers whose last known address was in the state of Washington and who drove for Defendant in the state of Washington for at least some portion of one or more weeks from November 15, 2015 through March 13, 2023 excluding individuals who have released their claims against Defendants during that time period, as explained in the California and Washington Class FAQ section of this website. 

FLSA Collective: Defendant's long-haul drivers whose last know address was not in either the state of California or Washington for at least some portion of one or more weeks from September 1, 2019 and March 13,  2023, and who submit a timely and valid Consent to Join on ore before July 3, 2023. More information about the FLSA Collective can be found in the FLSA Collective FAQ section of this website. 


This website is authorized by the Court, supervised by counsel and controlled by Kroll Settlement Administration LLC, the Settlement Administrator approved by the Court. This is the only authorized website for this case.

    Exclusion Deadline

    Monday, July 3, 2023 If you a member of the California or Washington Classes and wish to exclude yourself from the settlement, you must complete and mail your request for exclusion form so that it is postmarked no later than Monday, July 3, 2023.
  • Objection Deadline

    Monday, July 3, 2023 If you wish to object to the settlement, you must mail your objection(s) and/or notice of intent to appear at the Final Approval Hearing so that it/they are postmarked no later than Monday, July 3, 2023.
  • Consent to Join Deadline

    Monday, July 3, 2023 If you were sent the FLSA Notice, you must submit your Consent to Join Form no later than Monday, July 3, 2023 , by mailing your completed Consent to Join Form so that it is postmarked no later than Monday, July 3, 2023.
  • Final Approval Hearing Date

    Thursday, July 6, 2023 The Final Approval Hearing is scheduled for Thursday, July 6, 2023. Please check this website for updates.
